Tennessee court grants new trial for Black man after all-white jury deliberated in room with Confederate symbols

Unbeknownst to Gilbert or his attorney at the time of the trial, the jury considered whether Gilbert was innocent or guilty in a room where an antique Confederate flag and a portrait of Confederate President Jefferson Davis hung.

The room, decorated with other related memorabilia, is also named for the United Daughters of the Confederacy, the organization founded in the 1890s in Nashville to memorialize Civil War ancestors and memorials.

The ruling, issued Friday, found Gilbert’s defense provided enough evidence to show how a jury could be influenced while deliberating in such a room, while also making it clear Tennessee’s attorneys didn’t adequately respond to the allegations.

New York Times Opinion: It’s Quitting Season

Excellent video opinion piece by Lindsay Crouse and Kirby Ferguson (of Everything is a Remix fame).

Winners never quit, and quitters never win. We Americans are told some version of this again and again. Our country wasn’t built on quitters. As Bible-loving Americans, we were taught that perserverance is virtuous, and this message finds us everywhere we go — even when we try to escape into fantasy. We demonize quitters. We think they’re pathetic. What if sometimes quitting isn’t cowardly at all, but smart? What if we’ve been wrong about quitting our entire lives?

This is an excellent, thought-provoking video.

Without a doubt, “Winners never quit, and quitters never win” is perhaps the most fallacious thing we were ever taught as kids.

Tennessee #1 for new COVID-19 cases by population, CDC says

NASHVILLE, Tenn. (WKRN) — Tennessee has the highest number of new COVID-19 cases by population of any state in the U.S., according to data from the Centers for Disease Control and Prevention.

The CDC’s coronavirus website shows Tennessee with a high level of transmission of the virus, and a seven-day case rate of 790.1 per 100,000 people.

As I said just the other day, “the average Tennessean is neither smarter nor more educated than national average, they aren’t and haven’t been wearing masks to greater percentages than the national average, and they certainly aren’t getting vaccinated anywhere near the national average.”
